Procrastination & other things
And I've found the way to get rid of it! Well, it is fairly obvious=P Goals, goals and goals! The more you have, the more you have to achieve something by the end of it and the more motivated you are to do something=D It works;)
Anyways, on another note, I read this amazing article in The Weekend Australian Magazine (May 9-10). It was titled, "My mother, myself" by Vanessa Hunter. I don't think it's on the internet but anyways. I can really relate to it.
Some stuff on the article really stood out to me and here's just one of them "All I can do is remember that there were things she hadn't yet taught me, wisdom she still had to impart."
Anyways, some of you know what I'm talking about and other's probably don't mais ca marche.
Anyhoo, enough about the serious stuff=P It's Week 10 and it means that Exams are coming up! Yay! I have 5 exams this semester, including a pointless French culture one which I have learnt nothing in=P Except for names like Baudelaire and Haussman. Anyways, I'm pumped to get them all done with=D
4 Weeks till ILR...get pysched everyone!=P Maybe we need a dose of Barney's psyche mix!
But it's oh so useful. I'm referring to Contract (K) Law. Seriously, when you buy a car and you want to know whether it is an 'express term' that they will service your car before, when you get an infrigement from Connex and you want to know if you can get out of it, when you buy a drink from the vending machine. Everything is relevant. I guess doing Law makes you see the world in a whole different light. I'm being a detriment to you cause you're reading this and I'm wasting your time=P
I like talking about Law, don't I! I must really like it=P

Planning
Haha, what a quaint title! The short message and the general rule is DO NOT PLAN, it NEVER WORKS! Now like law, there are always exceptions to this 'general rule' but let's not look at them for now=P And I know one person in particular will oppose this entire argument!
Now I will illustrate these in various examples. All right, we all know about 'Procrastination', it's when you sit down and go 'I will do this' and you find a million other things to do and you do not do what you were meant to do!
So you plan to do something and you don't do it! Thanks procrastination. Much like now, I am meant to be doing an essay on the stability of the Cold War but 'meh'! I've had enough of nuclear weapons for a while....I will get back to it 'spontaneously sometime'=P Well, it is due on Thursday so I will have to do it.
Ok, illustration 2. You plan a thing, or someone else does, and bang something unexpected happens (not at the fault of anyone) and it gets cancelled. So all that planning to do something that you wanted=dead!
Ok, illustration 3. You plan something and some people decide to go 'oh i can't be bothered replying' and don't bother! Which is extremely annoying sometimes, however, I'm not without fault, I do that with 1 person...=P 'meh' I have my reasons....
Now, I'm not going to the exceptions but anyways LONG LIVE SPONTANEITY because it is the only thing that seems to work in all our busy lifestyles. Because 'Oh, it's the end of the lecture, let's go do something' or 'Hey, we're all here, let's all go to Southland now' works better than 'oh, let's keep this night free so we can do something.' I'm busy yayayaya and it goes on and on and on and the endless cycle continues! On another issue, I thought third time was lucky, guess I was wrong=P
Wow, that was a long rant! Why have I written it, because at the end of the week, I had to change three things that were going to happen that did not! Therefore, planning failed but spontaneity seemed to work. Anyways I'm not blaming lack of planning, I'm just saying it doesn't work for everyone. And, I know, you love your friends (platonically) and want to see them hence you persist!
Oh and on another note, if you want to really annoy me then tell me you'll do something and don't do it! This has to be one of the most annoying things in the world..'Hi, Tuesday sounds good, I'll organise the deets later...' *pft* yeah right!
In other news
What's everyone up to? Just estopping myself from doing estoppel atm=P I am finding law enduring yet so interesting! All these tiny little facts that you pick up!
The Boring Law Bit=P
Anyways, thought I would get away for a while since we're going through an area called 'Estoppel' and NO ONE agrees on anything (silly High Court judges) Can you not come up with one solution? Is it really that hard to agree on something and only publish that in the law reports?
It's virtually, yes, we'll combine common law and equitable estoppel and unify the concept. No we won't, it would be stupid. Yes, this is what you get if you claim for common law estoppel and this is what you get if you claim for equitable. No, we're not going to enforce your promise because it wasn't detrimental enough for you and it wasn't unconscionable etc.
A particularly interesting case in this area is W v G (If you're in a lesbian relationship and you have a kid with the help of your partner and she ditches you, is she entitled to pay for the child's welfare?)
See all these interesting questions that law brings up=P
Family law act doesn't apply because it's a lesbian relationship. Next question, ESTOPPEL! But is the child a detriment to the person? Is the act of having a child a detriment and can everyone cliam against it? I particularly liked Davison when he was talking about this. 'Hi [to the child], you're worth negative $150 000, how do you feel being a detriment?'=P
I also find it extremely interesting how judges avoid the DIFFICULT QUESTIONS!
Anyways, it all worked out fine, she got her equitable estoppel claim as she was induced into having kids through artificial insemination by the other chick. Although, she only got $150 000 to raise both her kids for the rest of thier lives.
Is that fair? I wonder how she's going to go about explaining this to her kids when they grow up!
What else have I learnt? I've learnt how to bypass (so has our whole ILR class) the Surveillance Devices Act which essentially stops people from 'stalking you' and installing cameras in your house and doing what not=P I don't know how useful that's going to be haha=P I'm sure the Parliament has been smart enough to legislate around these things now and if you did stalk someone you'd probably get done for some Tort.
I've learnt how to talk myself out of a fine if I drive off from a red traffic light, and get caught by the police, if it is 'malfunctioning' and it is stuck on red. Unfortunately, there are like 3 traffic lights at certain sections so if one dies the others still function.
I've learnt that one time prostitutes can get away from a penalty and conviction by arguing that they were not an 'occupier' of the place according to the Vagrancy Act. Although, this has probably changed now as it is a pretty old case.

The Answer
So a couple of weeks back I believe that I had this question I had to answer of 'fun' or 'nice'=P And I think I found the answer last night=P Am I going to share? No=P
Anyhoo, I just finished my court report so I am happy happy happy=D It's not very good but 'meh'! Apparently I am the QUOTE 'King of understatements' UNQUOTE and 'Evil', especially when I threaten to a)push you into the Yarra b)push you off a ferris wheel c)push you off a train or d)king hit you and kill you=P
If you have no idea what that means, I wouldn't expect you to=P
So what have I been doing over the Easter Break? Nothing too interesting to report but things go well. Back to uni on Monday and back to routine. I had this goal, I think most people did, that I would catch up on the last 6 weeks...Never happened! Did someone say procrastination?
Adam Hills was great the other night. That man tells a good joke! Oh, and I went to China town yesterday night...any guesses why? haha

Reality Check
So I had a reality check today...I thought things were going alright at uni and then today hit me and 'Bleugh...', that is all I have to say! Not that I am just judging it from everything I write here...guess it is just building up...
So, it all started at 10am today! First contracts tute ever...I was excited, well, not really! Saw ajit driving into uni, on a random note!
Anyways, you would think that you walk into a tutorial and have this 'friendship/meeting new people' type atmosphere going on (well that is what happens in Arts tutes and it is fantastic that way). Usually, there is an icebreaker where you introduce the person next to you or tell the rest of the tute who are you are etc.
NONE OF THAT...in the Contracts Tute! Yes, we have 'too much' to cover but still...!
When you walk into a law tute, it's more like 'I am really not your friend, even though I am going to pretend to be your friend, I just want those tutorial participation marks and I'm going to get them over you..because I am going to speak more than you...!'
Seriously, the atmosphere in one of those tutes is like an exam room. Everyone is being evaluated and everyone, even if it is deep down, is going 'I am better than you'. And if you actually don't do the tute work for law...you're stuffed!
Well I have had my rant about law tutes. Guess I have to get used to it considering I have 5 years (including this year) ahead of me! Oh well, I still have Arts to keep me sane=)
And I am not the only person who thinks these are the way these tutes operate. Seriously, you can apply the Objective Person test for all I care and the random person sitting in on the tute would think the same!
Had my ILR (Intro to Legal Reasoning) test today, it was 'meh' but I am glad to get it over and done with! Now to focus on the Court report and actually get going on it.
In conclusion, I need to get organised, time to organised..let's go!

Music...why me?
Anyways, my kind old radio in the car decided to play another song that I have not heard in a VERY long time=P Why are you trying to remind of the past silly music? Silly silly music=P Your attempts are feeble...! mwa haha!
Again, I am tired, shutup...I get my writing inspiration when I am tired=P Otherwise, there would not be any posts on this blog!
So, I said that last time my iPod decided to play 'Blind' by Lifehouse out of 450 something songs it could have played, while I was at Richmond station contemplating. Now my silly radio decides to join in by playing, let's call it 'That song', by The Veronicas. This is not on my iPod...I'm not that sad. Anyhoo, I had a good laugh and went 'Wtf...the context was very different last time we met hahahaha'=P Well, I didn't say that out loud because that would be sad.
Anyhoo, that's my 'evil past music is trying to follow me' story=P
Onto more recent matters. I hate choices but you have to make them don't you? If you cannot make them...wing it!
Contracts Assignment=10%+ Time OR 90% exam? Fun OR extremely nice and caring? More on that later! Quick breakfast OR slow breakfast=P Confrontation OR no confrontation? Foe OR Friend? Complication OR Silence? (Consideration tells me silence does not work=P) Ready OR not ready? Sincere OR not sincere? Truth OR lies?
And here's the life message=P Life is filled with lots of choices and lots of 'this or that' moments and you have to work out what is right! Trouvez une equilibre.
However, if you cannot process it all, comme moi, wing it;) If there is another thing I have learnt...nothing happens if you meddle/intervene. Things just happen.....;) lalalalala
So my brain cannot process these OR's at the moment so winging it is the best option comme j'ai deja dit.....;)!

Bffl?
So I just got home from le centre ville and my kind little Ipod decided to play a song that I have not heard in a VERY long time! This was because I was stuck at Richmond station for 20 extra minutes at like 11ish! Anyways, it made me start thinking...hmm, I wonder if I am exactly the same as I was back then or I wonder how much has 'actually' changed? The short answer is NO and it is really amazing when you look back at it and see how much you have grown and learnt as a person=) Cheesy, I know but oh well and hey I had a spare 20mins=P
By the way that song was 'Blind' by Lifehouse=P Significance? It was significant in my life before, but now it is just a passing memory. A small little speck that you acknowledge but look past=)
Anyways, this lead me to further contemplation. When you tell someone they are your bffl or vice versa DO NOT do it unless you really mean it because, let's face it, circumstances change and what you said before will not carry into the immediate future. Really, really, at the bottom of your heart, mean it! I don't know why I just mentioned that, guess I am just tired=P I could go into this more...NAH=P haha C'est le conseil de Nick pour ce soir;)
Wow, I talk about the past too much! So FUTURE time haha! Took a much needed break tonight from work that is still bogging me down=D Headed out to the city=) Did not actually see the effects of Earth Hour much...
What else? Looking forward to the Easter break coming up which will give me more of an opportunity to catch up with my good mates=) Also, handed in my application form for this volunteer thing (I wonder if I'll get it?) Well I'm up against 150-200 applications apparently!

Certainty
*Now for the boring bit*
Anyways, you know when you have a contract.
One of the essential elements is 'Certainty'. Now, courts will not enforce a contract between parties if the terms of a contract are not clear and certain for all parties. ie: you cannot go 'I will buy this house from you for around $300 000 to $500 000 and I might throw in something extra, as consideration, if I'm nice, but I do not know what?'
Now courts have the power to SEVER a term from a contract if the contract can still function in its entirety without the term. This is just an 1/16 of Certainty. There are exceptions but we do not need to go into those!
Now, if the only things you picked up were 'Sever' and 'still function', you have done a fantastic job! And you have learnt some law=P
And if that made no sense to you whatsoever, just look at some status updates on facebook as 'some people' have status' that like being ambiguous ......And some people, have blogs that are partially 'ambiguous' but you can pick up their 'true' meaning.
Anyways, I am off on my tangential spiral down to nothingness!
Finally taking a break from all this work tonight and heading into town=D
Oh and finally, 'Eh, eh, there's nothing else I can say.....' It feels alot like that sometimes....

Sick of it!!
You know, there comes a time in your life, or multiple times, where you're like 'Why do I bother with something...?' You have to constantly and consistently ask yourself, 'Hmm, I wonder if I'm doing the right thing..?' And quite frankly, you move a step forward and it just feels like you keep getting knocked back so in the end, it essentially leaves you disheartened to do anything else or want to do anything else, even though you try.
And when you end up doing something 'nice' or 'good' or even 'horrible' it ends up being 'Why am I doing this/Why do i bother...?' I now see the viewpoint that some people in the police force take. That you do something important, trying to do good, but hardly get recognised. Now in a hypothetical situation Party B would not understand no matter how much you emphasise this point. But then again, Party A 'might or might not' see the viewpoint of Party B. Or chooses to see 'other things' instead of the main thing. Or is just plain selfish? I don't know, and I'm not going to read into it! In the end, I guess you just stick with it hoping to break out of this stupid stupid cycle of doom....!! Well it is not that severe...it just a horrible cycle which likes to repeat itself CONSTANTLY...
By the way, this has nothing to do about choosing Law. It's fun=)

Seriously this guy is an awesome lecturer! I haven't found anyone else as entertaining yet. Mind you my French culture person seems to be terribly interested in Prostitution in Paris in the 19th century. Today, I learnt that the lights (a symbol of the vibrance of Paris) of the street, illuminated the prostitutes so you could see them better...I'm still questioning why I am doing this subject?
Anyways, I've had my rant! Moving on...Life is good! Catching up occasionally with the people who you really care about makes a massive difference. Whether they know it or not. Seriously, there is mountains of reading to be done on Consideration, Intention, Certainty and so forth but you really come to appreciate the time you get off/the times you can just let your brain wonder. Like now, hence why I wrote the first bit....because I have let my brain wonder into the abyss of thinking and that is not a good place to be.....

Behind
As future Nick, now present Nick, I am already 2 weeks behind with stuff! A culmination of French, Law and International Studies haha! I really should not be laughing hey=P I still have to find that work/life balance=P I think the 'life' has been taking over the 'work' more! Mind you, I do not have a job either so I guess that gives me alot more time=D
Anyways, what else has been happening since my last post? I went off to Law Camp. "F*** you I do law..." Enough said. Haha, that was our anthem! It's on my facebook.

It goes on with "I have a private education etc. etc." How pretentious=P I wonder when I'll be wearing a collared shirt everyday haha=P I probably won't, so don't worry.
But, overall I'm enjoying law! It is interesting! Especially when your Contracts lecturer, Davison, makes up his 'Vegemite Sandwich Doctrine' and does Tai Chi to demonstrate a dispute about Tai Chi=P What was it? Patting the bird and Opening the door? I don't even remember the case, just the Tai Chi=P

Something just doesn't feel right!
What a riddle? I will tell some of you later...;)!
Anyways, Uni is awesome! It has been a blast so far. Mind you, I need to get working on some work for this week.
Monday night, I 'tried/attempted' to get some work done. Reading Gibson v Manchester City Council becomes extremely dull after a while. Carlill is more exciting, although I do find it ironic that she ended up dieing of influenza in the end, after she sued the smoke ball company for 100 pounds for catching influenza in the first place. Fun fact from Davis (contracts lecturer: he loves that metaphor of the trees and the forest)
Tuesday night was a good night=) After, my busy 5 hour straight day, headed back to Nando's to say goodbye to my 'I make the chicks hot' t-shirt and all the rest of my uniform=)
Then headed out to dinner and a movie (Last Chance Harvey, c'est pas mal). Dammit, you beat me at bowling AND air hockey TWICE=P Anyways, once again, I did not get any work done when I went home.
Wednesday night was the ILSA trivia night. We came last=P Honestly, with answers like "Who won the booker prize (or something) last year in literature" and putting "The Yellow pages" (Go team=P) was a recipe for disaster. However, free pizza and chips are always good. I have to say that the LLS is 'more fun' than the ILSA. I guess it is the more serious society.'
Tonight, I WILL get some work done *fingers crossed*.
Other than that, uni during the day has been awesome. Met some awesome people too! Seriously, everyone is really nice at Monash. I think I have finally grown out of the 'Oh my god, I am sitting in a lecture where I don't know anyone' phase=P Mind you, I did get taken along to a 'Beginner Spanish' tutorial yesterday. It was fantastic. Thankfully, the tutor did not notice that I "was not" doing Spanish. Haha! Me llamo Nick. Como estas? Hasta lavista and Muchos Gusto=P
And with that, I will bid you 'au revoir' (French 5 is extremely difficult!) AND LAW CAMP TOMORROW! Booyah!

"I am a ghost" (New Start to the year)
I cannot believe Uni starts again tomorrow! Is it sad that I'm actually looking forward to it? As future Nick I am going to write "Oh my god, there is so much reading and assignments, I am going to die!" But, more on that in the future....=P
It's felt like oh so long, since I left the old hallowed (I don't think I should go that far in saying that=P) institution of Melbourne University.
Although, like I always say these days, "good times ahead!"
First class of the year is a French Lecture..yay? And then I've got a Contracts lecture and I'm done for the day. Although, I have a 3 hour gap in between. What to do? Hmm? Court report assignment...lame!
Finally I will end on this note, which is a excerpt from a letter...

Quick Update!
I told myself, at the end of last year, that this year would be WAY BETTER! And guess what? It has been WAY BETTER so far!
Or as Barney Stinson would "LEGEN *wait for it* DARY" (I've watched 3 seasons)!
There were just some minor 'issues' getting me down before but all fixed! And, I've dealt with everything that has been making me unhappy=D! BE GONE UNHAPPINESS!=P
I've been on a much needed holiday overseas (best beach ever!), transferred universities to take up Arts and Law (hello Monash), quit my job at Nando's (don't EVER work there...) and the best bit...making new friends and keeping in touch with old friends=)! What more could I want?
I guess if this year had a title, it would be 'Go out there and do everything you want to do and not let anyone stop you (year)!' And Wow, that was long. How about the shorter title of 'The Opportunity Year'
I've had 2 days at Monash this week for welcomes from both faculties (Arts and Law) and the Dean of Law is actually pretty cool=P Mind you that 'Let's make your time at Monash 'magical' like Harry Potter' (guy) was pretty funny! And the other person who said 'This session is over, now go do what you students normally do like smoke bongs etc." Wtf lol....Highly entertaining!
I've signed up to various clubs. Including the Chocolate Appreciation Society (hey it was only $2), Law Students Society, Society of Arts Students, Debating and French. Wow=P And now I don't have a job, I'll actually have time to attend most of their stuff! Mind you, I have spent a fair amount of money on a culture card and signing up to those clubs! But hey, it's supporting the student union so why not?
And a note on THE PAST
It's amazing how much free time you get when you're unemployed/not working! Sucks about the money though! 'Meh', I'll manage!
I guess that was what I missed the most before I got a job at Nando's (the free time). Mind you, I didn't do much before I had a job Nando's. HA! Gone were the days of 'I'm going to be quiet at Uni and pretend nothing is wrong'! How depressing! Anyways, that is DONE! I question the state of my mental health last year.....=P mmmm...
Sorry, I have to admit....this year's O week was much better than last years at Melbourne! Everyone is so nice! And there is so much to do! You really don't feel like a sheep when you have your law mentor groups and the bbq's and the gatherings etc.
All in all, I need to find something new to do this year. I think I already have=) French club, debating comps., thinking about volunteering for the Clayton Community Legal centre too! Mind you, I also want to go on Exchange to Prato later. Perhaps, Canada or even back to Malaysia? Lots of options!
Hmm, last year, I got a job at Nando's, signed up the gym, took up swimming again=P oh and issues...HA, that was a fair effort=P *pft* enough about that!
Anyways, I'm rambling about extremely random things! I have to go do some law stuff now!
